Govt violated GTA terms, Morcha tells high court

The Times Of India
KOLKATA: GJM assistant secretary BenoyTamang on Monday filed a writ petition in Calcutta high court against the MamataBanerjee government, accusing the latter of violating the tripartite agreement to constitute the Gorkhaland Territorial Administration (GTA). The case is likely to be heard next week.

In his petition, Tamang drew the attention of the court to the 2011 tripartite agreement that specified all decisions concerning the GTA would be taken in consultation with its elected members. The petition alleged that contrary to the agreement, the state government appointed the Darjeeling district magistrate (DM) as the GTA’s principal secretary and bestowed him with all financial and executive powers without consulting GTA chairman Bimal Gurung and board members of the elected body.

The petition then sought the high court’s intervention so that the state government takes decisions regarding the GTA in consultation with its elected board in accordance with the tripartite agreement. If the state continues to violate the agreement, it would vitiate peace in the Hills and retard development of the area.
